Types of claim

Slip or Trip
An accident which has occured where you may have been injured as a result of falling, tripping or slipping on an uneven surface or a wet or slippery surface which in general opinion could have been prevented should the surface have been even or dry and was not condusive to you or others walking without incident.

Road traffic accidents
An accident which has occurred where, under normal circumstances and road traffic law, the accident could have been prevented should the driver of the vehicle responsible have driven with the skills associated with being a competent driver which would be paramount to not only his passengers but also to pedestrians and other road users and their safety.

Accidents at Home
It is the duty of the owner or tenant to make sure that all visitors to the home are safe from harm and injury. This includes all boundaries of the property also. As an example, if a postman walked down the path of a persons home and fell over a discarded childs bycycle and as a result, the postman suffered an injury, the postman, under normal circumstances, could make a claim. In most cases, the buildings or contents insurers of the property would be the defendant.

Accidents at work
These type of accidents are ones that may have occured as a result of an incident which has resulted in an injury which under normal circumstances, could have been prevented. Some examples would be, lack of training, lack of safety measures or equipment., faulty equipment, working in confined spaces or unreasonable requests by a superior to do work which may result in an injury.

Injury on Holiday
These types of claims are where injury may have occured as a result of negligence of the holiday company/tour opeerator/hotel/airline. The responsibility normally lies with the tour operator who's duty of care is to the clients where, under normal circumstances, should have a holiday free of disturbance and danger which may result in injury.

Victim of Violence
A victim of an assault which has resulted in an injury. You may also include psychological damage and possible loss of earnings. To make a claim of this type, it would be directed to the Criminal Injuries Compensation Authority who would evaluate the claim under strict terms and conditions. The incident must have been reported to the police or an apropriate authority and you must have co-operated completely and reported it correctly.
